Acknowledgment

These are the Terms and Conditions governing the use of this Service (Service refers to providing Ready to Ship and custom designed rings and jewelry to paying Clients) and the agreement that operates between You (referred to as “Client”, “We”, “Our”) and the Company (referred to as “Forma Fine Jewelry Inc.”). These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

Goods and material availability
Errors in the description or prices for Goods
Errors in Your Order

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

Your Order Cancellation Rights

Any Goods you purchase can only be returned in accordance with these Terms and Conditions and Our Returns Policy.

Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Price Policy

The Company reserves the right to revise its prices at any time prior to accepting an Order.

The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company.

Custom Designs

Deposit:

When working with us on a custom design, 2 types of deposits may occur if applicable:

Gemstone sourcing deposit (a value of 50% of the required sourced gemstone)
Design deposit (a value of 50% of the design and creation of the setting)

Deposits go towards the total balance of the completed project.

Deliverables:

Included in the cost of your custom piece is the initial 60 minute consultation (1 60 minute session or 2 30 minute sessions held virtually or in-person) with a stylist, a design mock-up via emailed CAD drawing for approval, 1 round of modifications prior to production.

Once the final design is approved via writing (in email format), and all deposits are paid, the ring will move into production. Changes cannot be submitted beyond this point without incurring additional design costs via a change order. Any requested modifications outside of the approval process will be at the Client’s expense.

Payments:

Payment schedules are as follows for custom projects:

Payment 1: Sourcing Deposit and Design deposit

Payment 2: 50-75% of the remaining balance

Payment 3: Final remaining balance due prior to jewelry shipment or pick up

The Client must pay outstanding/final balance within 14 days of the project completion. Clients are responsible for paying sales tax on all items purchased from Forma Fine Jewelry Inc. By paying the deposit, the Client understands and agrees to the terms and conditions on this website.

Disclaimers

When working on custom designs, we understand that working with heirloom materials and gemstones may be a possibility. Forma Fine Jewelry Inc. is not responsible for heirloom settings that chip, break, bend or are damaged. Photos of each heirloom item (settings and stones) will be taken prior to working with them. Clients understand that working with heirloom material is “a risk” and Forma Fine Jewelry Inc. will not be liable for any damage that may occur during the production process. Please note that adding heirloom jewelry (or any other jewelry items of importance) to your insurance policy will protect against loss, damage or theft. We advise our customers to insure their important pieces of jewelry for these reasons.

Timelines

Our timelines are estimates, as each custom project is unique. Custom projects can take on average from 10-16 weeks depending on gemstone sourcing, payment schedules, response times, holidays, and design time.

Returns:

All custom made rings are final sale.

Ready to Ship Designs

Unless otherwise noted, unworn Ready to Ship rings can be exchanged within 15 days of receiving the item. Exchanges can be made for a store credit or another design, less 15% restocking fee. Additional fees will be added to the order of your Ready to Ship ring should you need resizing, and resizing will be available only if the required size change does not impact the integrity of the ring's design and setting.

Craftsmanship Warranty

All our jewelry have a one year warranty on structural integrity and craftsmanship from the date of completion.

During the one year warranty period, we will repair your piece free of charge for any structural integrity flaws that could have occurred during production. This does not include damage to stones, self-inflicted damage to the setting or the stones, wear and tear from regular use, or damage from not using your jewelry as intended. It is the Client’s responsibility to take care of their jewelry and insure it to cover any damages to the gemstones.

Forma Fine Jewelry Inc. does not offer warranty on main/centre gemstones. Lab diamonds, moissanite and centre gem stones larger than 2.5mm in width are not under warranty. We encourage all our customers to insure their jewelry to cover gemstone damage.

For side stones 2.5mm in width and under, Forma Fine Jewelry Inc. will replace any missing stones for free within 6 months of the recipient receiving the ring. Each request for repair can be submitted through our Contact form, and will be assessed on a case by case basis.

All shipping costs for repair requested by the Client will be at the Client’s expense. All shipments from Forma Fine Jewelry Inc. require a signature and are fully insured.

Should repair be needed, please contact us at hello@formafinejewelry.com and we will provide instructions on how to begin the repair process.

Resizing

One complimentary ring resizing is included in each order if the order is a gift (the receiver is not present for sizing at the time of ordering, or at consultation). Gifted rings can be sent back to us for resizing within 60 days of the ring being gifted.

If you require further resizing, please contact us as additional resizing will incur an additional fee.

Please note that not all ring styles can be resized due to gemstone settings and designs. A stylist will evaluate the ring to see if it can be resized without compromising the integrity of the ring’s structure.

Please note that resizing and modifications to the ring done by any jeweller not recommended by Forma Fine Jewelry will void the one year warranty with us.

Diamond and Gemstone Sourcing

Forma Fine Jewelry sources quality stones and materials from a small group of trusted partners around the world. We source only high quality design quality materials, genuine lab made diamonds and gemstones with a clarity of S1 and higher.

Appraisals

Forma Fine Jewelry Inc. works with independent appraisers. Free appraisals can be included with any ring purchase valued at $8000 CAD and higher. Appraisals can be added to any ring purchase for a fee, if the ring value falls below $8000 CAD.

Shipping

All shipments from Forma Fine Jewelry Inc. are insured and require a signature. Domestic shipments are shipped via FEDEX or UPS or Canada Post. Express shipping can be arranged when purchasing your ring online. Otherwise, shipping is not reflective of production speed. Most designs are made to order, and shipping will occur once the ring is completed, and all payment is received.

International pieces will be shipped via DHL Express Worldwide where applicable, or FEDEX and will be insured.

International Clients

Forma Fine Jewelry Inc. is happy to work with Clients outside of Canada! With the help of virtual consultations, flexible work hours, and high resolution video and photography, we are able to make your ring dreams come true even if you are on the other side of the world. Please note that each country assesses taxes and duties differently, and may need to be paid to clear your items upon arrival at your country’s border. All customs fees, taxes and duties are the Client’s responsibility.

Returns and Exchanges

Unless otherwise noted, unworn Ready to Ship rings can be exchanged within 15 days of receiving the item. Exchanges can be made for a store credit or another design, less 15% restocking fee.

Forma Fine Jewelry Inc. does not offer returns or refunds on any of our rings and jewelry.

Forma Fine Jewelry Inc. does not offer returns, refunds or exchanges on custom made rings and jewelry.

To initiate an exchange on an unworn Ready to Ship item, please contact us directly at hello@formafinejewelry.com. Exchanges and store credits on Ready to Ship items will be given upon inspection of the original item.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
